Terms of service

By creating a Kithnkins account or using the service, you agree to these terms. If you don't agree, please don't use the service. We may update these terms over time — see “Changes to these terms” below.

These terms form a binding agreement between you and [Your Company, Inc.] (“Kithnkins,” “we,” “us”).

Kithnkins is a relationship management tool for solo professionals. You use it to keep track of the people in your life — clients, prospects, referrers, friends — and remember what's important about them. It is not a sales CRM, a marketing platform, or a contact-scraping tool, and these terms reflect that.

To use Kithnkins, you must:

• Be at least 18 years old
• Provide accurate information when signing up
• Keep your password secure — you're responsible for activity that happens under your account
• Use the service for your own personal or professional use, not on behalf of someone else without permission

One person, one active account. If you operate multiple businesses or personas, one account covers all of them; please don't create duplicates to circumvent any limits.

You own your data. We don't claim any rights over the contacts, notes, or content you put into Kithnkins. You can export it anytime. If you cancel, we hold it for 60 days in case you come back, then delete it.

You grant us a limited, non-exclusive license to host, store, and process your data — only to the extent necessary to provide the service. We don't sell it. We don't share it with advertisers. We don't analyze it for any purpose other than running Kithnkins.

Because Kithnkins stores data about other people in your life, you also acknowledge:

• You have a legitimate basis to add the people you add — meaning you have a real relationship with them, professional or personal
• You will respect their privacy. Don't use Kithnkins to track people who haven't consented to be in your professional network, to harass, stalk, or surveil anyone, or to compile data for sale
• If a contact asks you to remove their information, you'll do so promptly. If they reach out to us directly, we'll forward the request to you

You may not:

• Use Kithnkins for illegal purposes
• Use it to harass, stalk, or harm any person
• Attempt to access other users' data
• Reverse engineer, scrape, or systematically extract data from the service
• Resell or sublicense access to your account
• Use bots or automated tools to interact with the service (other than our published API, when available)
• Upload viruses, malicious code, or anything designed to disrupt the service

We may suspend or terminate accounts that violate these rules. We try to be reasonable — accidental violations get a warning first; serious or repeated ones don't.

Pricing. Kithnkins is $19 per month or $190 per year, billed via Stripe. Founding members who joined the waitlist before public launch may be entitled to a $9/month rate — see Section 7.

Trial. New accounts get a 14-day free trial. No credit card required to start. We'll remind you before it ends.

Auto-renewal. Paid subscriptions renew automatically until you cancel. The renewal date is the same day each month or year as your initial subscription date.

Cancellation. Cancel anytime from your account settings. Your subscription stays active through the end of your current billing period. After that, your account becomes read-only — you can still see and export your data for 60 days, then it's deleted.

Refunds. We offer a full refund within the first 14 days of any annual subscription. Monthly subscriptions aren't refundable, but you can cancel before your next renewal to avoid being charged again. If you have an extenuating circumstance, email billing@kithnkins.com — we're reasonable people.

Price changes. If we change pricing for new customers, your existing rate is honored for at least 12 months from the change. Founding member rates are protected for life as long as your subscription stays continuous (see Section 7).

Failed payments. If a payment fails, we'll retry over 7 days and email you each time. If we can't collect after that, your account moves to the same read-only state as a cancellation, with the same 60-day window before deletion.

If you joined our waitlist before public launch and converted to a paid subscription within 60 days of that launch, you're a founding member — $9 per month for life, as long as your subscription remains continuous.

The founding rate is protected by these conditions:

• It applies to your monthly plan; an annual plan at the founding rate is $99/year
• If you cancel and later resubscribe, you return to the then-current standard rate
• If we discontinue the founding tier (we don't plan to), we'll give you 12 months' notice and the option to lock in your rate at another tier

We aim for high availability and we host on reliable infrastructure (Supabase, Vercel, Stripe), but we don't make formal uptime guarantees at this stage of the company.

If Kithnkins is unavailable for an extended period and you've been materially affected, email us. We'll work it out — typically with a partial month's credit. If a third-party service we depend on goes down (Stripe, Google, Supabase), we're subject to their recovery time, but we'll keep you informed.

We own the Kithnkins service: the brand, the website, the code, the design, the marketing content. You may not copy, reproduce, modify, or use those materials without our written permission, except as needed to use the service normally.

You own your data and any content you create within the service. We claim no ownership over your contacts, notes, or work product.

You can cancel your account anytime from your settings.

We can terminate or suspend your account if:

• You materially violate these terms
• We're required to by law
• You haven't used the account in over 24 months (we'll email you first)
• We discontinue the service entirely — in which case we'll give you at least 90 days' notice and tools to export everything

If we terminate without cause, we'll refund any unused portion of your subscription pro rata.

The service is provided “as is” and “as available” without warranties of any kind, express or implied — including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We're not responsible for:

• Decisions you make based on data in Kithnkins
• The behavior or availability of third-party services we integrate with (Gmail, Google Calendar, Stripe)
• Loss of data caused by your own actions, such as deleting items or losing account credentials
• Outcomes of relationships you manage through the service

To the maximum extent permitted by law, our total cumulative liability for any claim arising from or related to the service is limited to the greater of: (a) the amount you have paid us in the 12 months preceding the claim, or (b) $100.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost business, lost data (where data loss results from the limitations of any service), or reputational harm — even if we've been advised of the possibility.

Some jurisdictions don't allow these limitations. If you live in one, parts of this section may not apply to you.

You agree to defend, indemnify, and hold us harmless from any claims, costs, or damages (including reasonable legal fees) arising from:

• Your misuse of the service
• Your violation of these terms
• Claims by third parties about data you uploaded about them — particularly if you didn't have a legitimate basis to do so

These terms are governed by the laws of [State, Country], without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in [County, State], and you consent to their exclusive jurisdiction.

Before filing any formal claim, please email us at hello@kithnkins.com. We're real humans and we'd much rather solve a problem directly than through a lawyer.

We may update these terms as the product evolves. For material changes, we'll email you at least 30 days before they take effect. Continued use of the service after the effective date means you accept the changes. If you don't accept them, you can cancel before the effective date and we won't bill you again.
